floragrubb.com (the "Website") is operated by Grubb & Nadler, Inc., doing business as Flora Grubb Gardens ("Flora Grubb Gardens," "we," "us"), 1634 Jerrold Ave, San Francisco, CA 94124. By using the Website, you agree to these Terms of Use. If you don't agree, please don't use the Website.
PRIVACY
Our Privacy Policy explains how we collect and use your information, and is part of these terms.
ELECTRONIC COMMUNICATIONS
When you use the Website or email or text us, you are communicating with us electronically, and you agree that we may reply the same way. Agreements, notices and other communications we send you electronically satisfy any legal requirement that they be in writing.
TEXT MESSAGING (SMS) TERMS
Program name: Flora Grubb Gardens customer care, operated by Grubb & Nadler, Inc., doing business as Flora Grubb Gardens. If you give us your mobile number and agree to receive texts, we may text you about your orders, pickups and deliveries, and replies to your questions. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help, or contact us at hello@floragrubb.com or 415-626-7256. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your mobile number.
ORDERS, PAYMENTS AND DELIVERY
Most of what we sell is chosen in our stores or with our staff by phone, email or video. Online payments are processed by Stripe. Prices, availability, delivery fees and timing, and our return policy for an item are confirmed with you when you order; if you have questions, ask us before you buy. We may decline or cancel an order, for example if an item is no longer available or a price was listed in error, and we will refund any payment for it. When we deliver, ownership and risk of loss pass to you when the order is delivered.
PRODUCT INFORMATION AND PLANT ADVICE
Plants are living things, and no two are alike. We try to describe and photograph them accurately, and our plant guides and advice reflect our experience in California gardens, but sizes, colors, availability and how a plant grows in your garden can vary. The Website's information is general guidance, not a guarantee of results.
OUR CONTENT AND TRADEMARKS
The text, photographs, graphics, logos and other content on the Website belong to Flora Grubb Gardens or the people who license them to us, and are protected by copyright and trademark law. You may view and share pages from the Website for personal, non-commercial use, and link to it as long as the link isn't misleading. You may not copy, sell or reuse our content for commercial purposes, use our name or logo in a way that suggests we endorse you, or scrape the Website with robots or similar tools, without our written permission.
LINKS TO OTHER WEBSITES
The Website links to other sites, such as social media and our partners. We don't control those sites and aren't responsible for their content or practices.
DISCLAIMER OF WARRANTIES
THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, FLORA GRUBB GARDENS DISCLAIMS ALL WARRANTIES ABOUT THE WEBSITE, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES. THIS DOES NOT LIMIT ANY WARRANTY THAT APPLIES TO PRODUCTS YOU BUY FROM US.
LIMITATION OF LIABILITY
TO THE FULLEST EXTENT THE LAW ALLOWS, FLORA GRUBB GARDENS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE. SOME STATES DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
GOVERNING LAW AND DISPUTES
These terms are governed by the laws of the State of California, without regard to its conflict of law rules. If a dispute comes up, please contact us first; most problems can be solved that way. Any dispute that we can't resolve informally will be settled by confidential, binding arbitration in California under the rules of the American Arbitration Association, on an individual basis and not as part of a class or representative action. Either of us may instead bring an individual claim in small claims court, and we may ask a court to stop misuse of our intellectual property.
CHANGES TO THESE TERMS
We may update these terms from time to time. When we do, we will change the "Last updated" date at the top. Using the Website after a change means you accept the updated terms. If any part of these terms is found unenforceable, the rest stays in effect.
